    Benoni Smith was executor of the will of his father-in-law, Caleb-3Pendleton. He was for many years a Justice of the Peace at Westerly andalso a Town Councilman. His own will, dated there 18 Nov 1762 (C & PRec., iv. 18), names wife, Ruth, son Nathan, daughters "Elenor" Saunders,Sarah Lanphere, Hannah Chapman, Elizabeth Burdick and Mary Babcock;grandchildren, Joseph Smith, William Smith and Joshua Smith; Mary Barber,wife of John Barber of Hopkinton (relationship not stated), and CalebPendleton of Stonington; the document then goes on to say "My will isthat wheras I have given bond to the town of Westerly to Indemnify thetown from all Cost and Charges concerning and maintaining of a bastardchild born of the body of Dorcas Clark, single woman, that my aforesaidwife and my aforesaid daughters shall equaly maintain the aforesaid childso long as it may be chargeable." Whether this was a child or grandchildof Benoni does not appear. His wife and son-in-law, Samuel Babcock, Jr.,were named as executors. Inventory amounted to 4925 pounds 10s.

    36. Ruth-4 Pendleton (Caleb-3), was born probably at Westerly, RI,and died there in 1787. She married (1) Dec 1726, at Westerly, RI, BenoniSmith; (2) Benjamin Wilbur.
    Ruth's second marriage is not upon recard, but her second husbandwas Benjamin Wilbur, who had also been married before. His will, dated 19Mar 1772 (Westerly C & P Rec., iv, 177), give to "wife, Ruth, the use andimprovement of one third part of the money that the land sold for thather former husband, Benoni Smith Esq. died seized of." On the 2d April1772, she gave receipt to Joseph Wilbur, executor to Benjamin Wilbur for27 pounds 12s, 1d," in full of what was given me by my former husaban,Benoni Smith, and also given to me by my late husband Benjamin Wilbur,dec." (Ibid., p. 183).
    That Ruth had some difficulty with her step-children in thesettlement of this estate is evident from the following: "At a meeting ofBenjamin Wilbur, being cited to appear before the Council to answer thecomplaint of Joseph Wilbur executor to Benjamin Wiolbur [that she hadconcealed some of the personal property of the dec.] appeared and madeoath that she had presented all the personal estate of said deceased tosaid Executor. . . in order that said Executor might make an Inventory ofsame" (Ibid., p. 203).
    Ruth probably died early in 1787, as on the 19th of March in thatyear inventory of estate of widow Ruth Wilbur was taken by Joshua andNathan Pendleton.

    He was a farmer and settled upon his father's land at Westerly. Onthe 26th of Jany. 1703, his brothers and sisters agreed "They having agift of land given us by our grandfather Bryan Pendleton to be dividedamongst us at our father's death, as per deed bearing date 31 Aug 1674;and our brother Caleb having built upon said land we mutually agree forourselves with full consent of father James, that our brother Caleb shallhave his part of land where he now is." Is recorded in the Westerly LandEvidence.
    He was active in town affairs and repeatedly held office between1698 and 1720, becoming Town Councilman in the latter year. Was admittedto the church at Stonington, 18 Feby., 1693, and was baptized with histwo oldest children the following 23rd of July, 1693. (Rec. First Cong.Ch., Ston., CT) His wife's name was Elizabeth ______. We lack record ofhis marriage but Charles H. Pendleton of Westerly thinks she was a sisterof George Lamphere, who had fenced part of James Pendleton's land.Caleb's Children, as given in the baptismal records of the Stoningtonchurch, and as named in his will.
