BIOGRAPHY: HON. NATHANIEL FOOTE, A.B., M.A., LL.D., of Rochester, New York, elected an annual member 30 Nov. 1926, was born in Morrisville, New York, 15 Nov.1849, the son of Nathaniel and Olivia Minerva (Knox) Foote, and died in Rochester 26 Jan. 1944. He prepared for school at Cazenovia Seminary and entered Hamilton College with the class of 1870, attending through sophomore year then leaving to teach school, and not returning for lack of sufficient funds. However, in after years the college conferred upon Mr. Foote the degrees of A.B., M.A., and LL.D., and the University of Rochester and Hobart College also gave him theLL.D. degree. Mr. Foote studied law in the office of his father in Morrisvilleand was admitted to the bar a Binghampton, New York, in 1870, and practiced later in Morrisville and Rochester. In 1905 he was appointed by the governor a justice of the New York supreme court to fill a vacancy for one year, and the next year he was elected to a full term of 14 years as justice of the court. In January 1912 he was designated by the governor to sit in the appellate division of the supreme court and continued as associate justice of that court until theexpiration of his term of office in 1919, when in January 1920, he was appointed acting official referee.
Judge Foote married in Rochester, 10 Jan. 1872, Charlotte Ann Campbell, daughter of James C. and Jeanette (Armitage) Campbell. They had five children, Nathaniel Frederick, Franc Estelle, Mrs. John Colgate Jessup (Louise Knox Foote), Mrs. Jerome Babcock Chase (Charlotte Campbell Foote), and Olivia Jeanette. BIOGRAPHY: Nathaniel Foote served as a private soldier in the Revolutionary War. He was at the battle of White Plains, and he was afterwards at New London "inthe Service" when the town was attacked. He was also a Minute Man.
He was drafted at two different times, and scores of people remember seeing Nathaniel Foote's old Revolutionary musket which hung over the mantel and was looked upon asa very rare relic. His papers of discharge from the service were sent to Washington, D.C., and were never returned, and were supposed to have been burned inthe Government Building when the British troops were in occupation in 1814. Because of this he received no pension. | Nathaniel FOOTE

died at about age 51
Nathaniel Foote was one of the first settlers of Wethersfield, C onnecticut.
He was born about 1593 in Colchester, Essex, England, and was ap prenticed to Samuel Croyle, grocer of Colchester, for a period o f 8 years on Sept. 21, 1608. ÒNathaniel Foote aged 16 years, so n of Robert Foot of Shalford in Com. Essex yeoman doth put himse lf apprentice to Samuel Croylye of Colchester, aforesaid groce r and Free Burgess from the Feast of St. Michael the ARchangel l ast past for the term of eight years. Dated 21 Sept. V Jame s I [1608]. Sealed and delivered in the presence of me Robert F oot and of me George Lumpkin.Ó
He immigrated in 1630 to Watertown, Middlesex, Massachusetts an d took the oath of freeman on Sept. 3, 1634 in Watertown. [Mass . Bay Colony, Men who took the Oath Sept. 1634-1636; Freemen mad e at the General Court, September 3, 1634] Nathaniel was one o f the earliest settlers in 1636 in Wethersfield. He was one o f the first ten settlers, known as Òadventures,Ó as was his wif e ElizabethÕs brother John Deming. He was granted a home-lot o f 10 acres in the original layout of the town in 1640 in Wethers field. Over the years, he became the owner of more than 400 acr es of land. Nathaniel represented Wethersfield in the Connectic ut Assembly between 1641 and 1643. He served as representativ e to the General Court in 1641, 1643, and 1644. He was stil l a proprietor at Watertown, although he had been living at Weth ersfield for six years, in 1642.
He was held in respect and confidence by his fellow townsmen, a s his appointments indicate. In May 1637, when the little arm y under Capt. John Mason was being provisioned for the memorabl e Pequot campaign, it was Òordered that there shalbe 1 hogg pÕvi ded att Wythersfield for the design in hand, wch is conceived t o be Nathaniell FootesÓ - a compliment, certainly from the colon ial authorities to Mr. FooteÕs ability to raise good pork. He d ied before 20 Dec. 1644 in Wethersfield, and his estate was inve ntoried there on that date.
The family as a whole had a large share in the tragedies of tha t early day, for Philip Smith, husband of Rebecca Foote, was ann ounced to have been Òmurdered with an hideous witchcraft,Ó amon g the members of the early generations, Nathaniel Foote had a da ughter-in-law and two of her children taken captive by the India nds and another child killed; a daughter and three of her childr en killed, which her husband and two other children were made ca ptives, and two more of her children wounded, and Frances Foot e lost two husbands to the Indians as well as one son-in-law kil led and another, with four of his children, taken into captivity .
